Terms & Conditions

By visiting or shopping on the Bucking Horse Outpost website, you accept the following terms and conditions and agree to the following statements. Please read them carefully.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. Bucking Horse Outpost reserves the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason, including changes in the economy, political and legislative changes, etc., without notice.

We will alert you about any changes by updating the “Last Updated” date of the Terms and Conditions, and you waive any right to receive specific notice of such change.

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in and revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted.

Customer Affidavit

  • I am twenty-one (21) years of age or older.
  • By selling or delivering ammunition to me, Bucking Horse Outpost is not violating any state or local law or ordinance.
  • I am not under indictment for and have never been convicted in any court of a felony crime.
  • I will not use products purchase from BuckingHorseOutpost.com in an unlawful manner.
  • I am currently not subject to a domestic violence restraining order of any kind.
  • I never have been nor do I expect to be convicted in any court of a misdemeanor crime of domestic violence.
  • I am not a fugitive from justice.
  • I am not an unlawful user or addicted to any controlled substance.
  • I have not been adjudicated as mentally incompetent nor have I been committed to any mental institution.
  • I am not an illegal or unlawful alien, and I am not a nonimmigrant alien.
  • I never have been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.
  • I have not renounced my U.S. citizenship.

Agreement to Indemnify and Defend for Misrepresentation

If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are untrue, you agree to release, hold harmless, indemnify, and pay to defend Bucking Horse Outpost and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution.

Product Sales

These terms apply to all product sales from Bucking Horse Outpost and may be supplemented by more specific terms when an order is placed.

Orders

All products offered for sale are subject to availability and Bucking Horse Outpost’s acceptance of your order. After you place an order on our site, we will send you an email acknowledging your order. This order acknowledgment means that your order has been received; it does not mean that your order has been fulfilled, shipped, or that the price of an item has been confirmed, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. Upon shipment of your order, you should receive an email with your tracking information.

Bucking Horse Outpost reserves the right at any time to accept, decline or cancel any order or limit order quantity for any reason. Bucking Horse Outpost uses its best efforts to fulfill orders, however, there may be instances in which a product is out of stock or unavailable. Bucking Horse Outpost also reserves the right to cancel an order if fraudulent consumer activity is suspected. 

Bucking Horse Outpost may revise, discontinue or modify products at any time without prior notice to you and products may become unavailable without notice. Bucking Horse Outpost shall have no liability of any kind if any product is not available.

PLEASE NOTE ALL SALES ARE FINAL.

Fulfillment

All BHO product orders are shipped by a third-party fulfillment service provider. Delivery lead times may vary, but most orders will be shipped within 10 working days. Shipping times are estimates only, and not a guarantee that the product will be delivered on the specified date. Once packages have left our Fulfillment Center(s), no address changes can be made. This is due to our Adult Signature Requirement and per Carrier policies. We will not be liable for any loss or expense which you may incur as a result of any delay in the delivery of your order. Bucking Horse Outpost assumes no liability for damaged, lost, or stolen shipments. It is your responsibility to ensure parcels can be delivered free from theft or exposure to rain, snow, excessive humidity, or temperature extremes. Claims for incorrect or missed shipments must be made to Bucking Horse Outpost Customer Support (at service@buckinghorseoutpost.com) within 10 days of order acknowledgment/shipment or are deemed waived. In the even that you submit a mis-shipment or damage claim to BHO, you will be asked to provide photographic evidence. Please note that the shipper (Bucking Horse Outpost) must be the party that files any claims with the carrier on damaged or missing shipments, not the customer. Carrier will not approve claims filed by shipment recipients.

Shipping Destination Restrictions

Bucking Horse Outpost does not ship ammunition outside the United States or to Alaska, California, Connecticut, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, Washington D.C., or any other area within the United States where we are prohibited by law from shipping similar products. If you attempt to have product shipped to these restricted areas, your order will be cancelled. Bucking Horse Outpost does not ship magazines outside the United States or to Alaska, California, Colorado, Connecticut, District of Columbia, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, Rhode Island, Vermont, or Washington.

Order Cancellation by Customers

Our goal is to ship your order as quickly as possible, so the moment you place your order our system starts preparing your products to ship. This means that you may not cancel or change your order once it has been submitted. (Some exceptions may apply.) Additionally, for your security, we cannot alter any product information or credit card charges after your order has been submitted.

Order Cancellation by Bucking Horse Outpost

We do not like canceling orders, but we reserve the right to cancel your order if you do not abide by these Terms and Conditions. If we choose to cancel your order, you will receive a refund of the full purchase amount, possibly less a cancellation fee.

Adult Signature Required

Be advised that an Adult Signature will be required upon delivery of ammunition products ordered from Bucking Horse Outpost. No exceptions.

Failure or Refusal to Accept Delivery

By placing an order with Bucking Horse Outpost, you agree to accept delivery of your order at the shipping address designated during checkout. If you fail or refuse to accept delivery of your order, then you may forfeit the full purchase amount, including any taxes and shipping fees, if applicable. To be clear, you may not receive a refund if you fail or refuse to accept delivery of your order. (Some exceptions may apply; to be reviewed on a case-by-case basis.) We understand recipient schedules may not always align with carrier delivery schedules, so we remind customers that both FedEx and UPS offer customers the ability to hold packages until they can be picked up. Returns and Shipping Claims

All sales of ammunition are final and usually are not to be returned. (Some exceptions may apply.) In the event that you submit a mis-shipment or damage claim to BHO, you will be asked to provide photographic evidence. Please note that the shipper (Bucking Horse Outpost) must be the party that files any claims with the carrier on damaged or missing shipments, not the customer. Carrier will not approve claims field by shipment recipients.

Credit Card Information

You may be asked to supply certain information relevant to your purchase of product from Bucking Horse Outpost, including credit card number, the expiration date, your billing address and your shipping information. By submitting such information, you grant Bucking Horse Outpost the right to provide such information to our third party-fulfillment service provider to facilitate the transaction. You agree to pay all charges that you incur on the website at the prices in effect when incurred, including without limitations any taxes and shipping/handling charges, if applicable. You represent and warrant that you have the legal right to use any credit cards used in connection with any transaction.

Pricing

Prices shown are in U.S. dollars. Bucking Horse Outpost reserves the right to change prices for products displayed on the website at any time, and to correct pricing errors that may inadvertently occur. (Please note that your Order Acknowledgment means that your order request has been received; it does not mean that your order has been shipped or that the price of an item has been confirmed.)

Compliance with Laws

It is your responsibility to ascertain and obey all applicable local, state, and federal laws (including minimum age requirements) in regard to the possession or use of any item purchased from Bucking Horse Outpost. By placing an order, you represent that the order is lawful and will be used in a lawful and appropriate manner.

Bucky Bucks Loyalty Program

The Bucky Bucks Loyalty Program (“Program”) is offered at the sole discretion of Bucking Horse Outpost (“Bucking Horse Outpost”, “we,” “our”, "BHO" or “us”).  The Program is available to individuals for their personal use only and is limited to one account per individual. Individuals who are residents of the United States (including its territories and possessions) and at least over the age of 18 years or older and who provide and maintain a valid email address are eligible to become members .By joining the Program and becoming a Program member, you (individually and collectively, “you,” “your,” or “Member”), agree that you have read, understood and agree to be bound by these Program Terms and Conditions of Participation (“Program Terms”) and by any changes or modifications we may make. 

You should review these Program Terms and the related policies and FAQs frequently to understand the terms and conditions that apply to the Program as they may change from time to time.  These Program Terms do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services.  By enrolling in the Program, you also agree to be bound by our Privacy Policy and our website Terms and Conditions, which are incorporated herein by reference. 

If you do not agree to these Program Terms, our Privacy Policy, and our website Terms and Conditions, you cannot participate in the Program.  The Program is void where prohibited by law. Only one Program account may be associated with a single email address.  In the event of a dispute over ownership of the Program membership account, the member will be deemed to be the authorized account holder of the email address submitted at the time of enrollment. Rewards is a tier-based program determined by the dollar value of their orders a member has placed within a single year on eligible purchases and through qualifying activities, beginning on the date of enrolment. Points will NOT apply for refunded or canceled orders. Points rewarded by the Bucky Bucks Loyalty Program are NOT redeemable for a cash value.

Bucky Bucks Loyalty members receive 1 point for every $1 spent on eligible purchases on BuckingHorseOutpost.com. Eligible purchases exclude sales tax, state fees, discounts, shipping and delivery charges and/or other excluded charges specified by us from time-to-time. All points earned from purchases on the Site are pending until your order is awaiting fulfillment, at which point they are fully matured and capable of redemption. Offers and rewards are available while supplies last and substitutions made by us in our sole discretion may occur. If your online order is not completed for any reason, any offers or rewards will be removed from your shopping basket and may no longer be available.

Rewards, benefits and/or points earned through the Program have no cash value, are non-transferable, and you have no property rights in or to rewards or other Program benefits.  Points credited to your Program account will be decreased or reversed, as applicable, if part or all of the purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Terms.  The sale, barter, transfer, or assignment of any rewards or benefits offered through the Program, other than by us, is expressly prohibited.

Release of Liability and Agreement to Indemnify and Defend

Bucking Horse Outpost is merely a retailer of products that are designed, manufactured, and tested by other companies. Therefore, you agree that Bucking Horse Outpost shall not be liable for any claims or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, in any way related to any of the products listed on BuckingHorseOutpost.com.

Furthermore, you understand and acknowledge that Bucking Horse Outpost disclaims all liability for the accuracy of information provided to you, and for how you use information provided to you by the company. You understand and acknowledge that Bucking Horse Outpost cannot be held liable for how you or anyone else uses any information received from Bucking Horse Outpost. Therefore, you agree to release, hold harmless, indemnify, and pay to defend Bucking Horse Outpost and its owners, agents, officers, and employees against any damages, including reasonable attorneys' fees, civil liability, or criminal prosecution arising from or related to your use of information provided by Bucking Horse Outpost. You further understand that manufacturers are the best resources for information about their products, including critical safety information. You must review all information and safety warnings from product manufacturers before purchasing and using products from BuckingHorseOutpost.com.

By placing an order with Bucking Horse Outpost, you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend Bucking Horse Outpost and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including, but not limited to, the use, storage, or transportation of the product. If any other party files a claim of any kind against Bucking Horse Outpost arising out of or relating to your purchase, use, storage, or transportation of products from BuckingHoseOutpost.com, you will indemnify and pay to defend Bucking Horse Outpost and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution.

Email List

In an effort to stay in contact with our customers and inform them of sales and specials, we retain a list of each customer's name and email address. By entering your information to create an account or by placing an order on BuckingHorseOutpost.com, you are authorizing Bucking Horse Outpost to send you follow-up emails about your purchase and emails with information about other products or services we provide. To be clear, by placing an order on BuckingHorseOutpost.com or by registering an account on BuckingHorseOutpost.com, you are choosing to add your name and e-mail address to Bucking Horse Outpost's email list. Your information will be retained and used in accordance with Bucking Horse Outpost.com's Privacy Policy. You may unsubscribe from these emails at any time by using the unsubscribe link embedded in one of these emails. Bucking Horse Outpost disclaims all liability for errors in pricing contained in emails and advertisements sent by Bucking Horse Outpost — all prices shown on our website are final.
